As a representative of high-end tea, was “金骏眉” a trademark owned by a company or a generic name for black tea? Recently, Beijing People’s Higher Court made the judgment of second instance on the review of opposition against the trademark “金骏眉”. The court ruled that “金骏眉” was an established generic name for black tea and it should have not been registered as a trademark, based on which the court ordered the Trademark Appeal Board of State Administration of Industry and Commerce to make a new decision.
The judge indicated this case was a reminder to the enterprises that they should care about intellectual property protection, including trademarks, to avoid their trademarks being generalized to a generic name.
