The Outline of National Medium and Long-term Program for Talent Development (2010-2020) raised requirements as “to formulate regulations on employee technological achievements, improve ownership and benefit sharing mechanism for intellectual property of scientific and technological achievements, and protect legitimate rights and interests of inventors of scientific and technological achievements”, According to such requirements, the State Intellectual Property Office (SIPO), together with the Ministry of Education, the Ministry of Science and Technology, the Ministry of Industry and Information, the Ministry of Human Resources and Social Security, the Ministry of Agriculture, the State-owned Assets Supervision and Administrative Commission, the National Copyright Administration, the National Forestry Bureau, the Patent Protection Association of China and the China Association of Inventions, drafted the Draft Regulations on Employee Inventions (Draft for Review) based on extensive research and collection of public opinions for a number of times. To make the public involve more deeply in the legislation of the Regulations, more than ten previous legislative documents, including the Draft Regulations made in several important time nodes and corresponding public opinions, major argumentations and key issues, symposiums and research reports, legislative documents and the introduction of the employee invention system from inside and outside of China, are hereby released in the hope that the public may understand more deeply and more comprehensively the major issues and corresponding argumentations raised during the drafting of the Draft Regulations, and that the public may continue to pay attention to the legislation work of the Regulations.
